Description

To make CPAs--internal accounting staff, internal auditors, and external auditors--aware of their respective responsibilities in deterring, preventing, and detecting fraud in a business enterprise.

 

The Committee of Sponsoring Organizations (COSO) of the Treadway Commission recently updated its Internal Control Integrated Framework to place increased emphasis on assessing fraud risk. The Government Accountability Office (GAO) also recently made changes to its “Green Book”—Standards for Internal Control in the Federal Government and issued new guidance on managing fraud risk in a Framework for Managing Fraud Risks in Federal Programs. The course will explain the importance of these recent changes and bring participants up to date on related developments.

 

The course will also explain the skills necessary to investigate and document cases of fraud—particularly what to do and what not to do when fraud is suspected and when fraud is being investigated. You will learn the relationships and interactions among internal accounting and auditing staff, external auditors, investigators, legal counsel, and law enforcement. The role that accounting professionals play with respect to these various processes and parties can be complex and needs to be undertaken with great care.

 

Program Description:

 

Most frauds aren’t discovered! At least not until serious damage is done to the organization! This ACPEN course will dissect the key elements of understanding and preventing Business Fraud using a combination of expert panelist discussions and a unique, specially developed Case Study Simulation that will bring the subject of Business Fraud to life!

 

Perhaps the most important step in fraud risk management is the conscious recognition and admission that every organization can become the victim of fraud and that the consequences of fraud can be catastrophic—both to the organization and the people involved.  Accountability professionals are tasked with the responsibility for assuring that fraud will either be prevented or will be detected before the impact becomes catastrophic.

 

Every accountability professional—accountant, auditor, controller, CFO, CEO, governing board member—should focus on fraud risk management.  Why?  Because, when fraud happens, it will be the accountability professionals who find themselves being asked, Where were you? Why didn’t you prevent this?  Why didn’t you detect this?

 

Business fraud is a problem that can affect every organization. Whether a for-profit or not-for-profit organization, for the business owner, controller, CFO, manager, financial statement preparer or auditor, fraud is serious business and it’s effects can be devastating. This fast moving seminar will provide a comprehensive look at fraud from  the technical, legal, and operational perspectives. It will combine lecture, discussion, demonstration and simulation in a practical, integrated explanation of how accounting and auditing professionals, in their various roles can successfully combat fraud.

 

Particular attention will be directed to the COSO Framework, The GAO “Greenbook” Update, and the new GAO Fraud Risk Management Framework for Governments. In addition, you will receive a summary of the 2014 Report to the Nations and an update on the Public Company Accounting Oversight Board (PCAOB) Fraud Task Force.

 

In addition, you will receive an update on Data Analytics and its use in the detection of business fraud. As a special feature, a panel of lawyers and prosecutors with broad experience in business fraud cases will explain the legal issues that CPAs, CFOs, Controllers and other financial professionals need to understand.

 

The panel of experts will address the unique internal control problems of smaller organizations with limited staff and resources. The program will address techniques for conducting inquiries of management, “brainstorming” and common types of fraud.  Learn and master new skills, such as conducting fraud risk assessment, brainstorming sessions and designing fraud control activities in response to fraud risk assessments to carry out your responsibility to make reasonable efforts to deter, prevent, and detect fraud. n addition, learn to identify and prevent common types of fraud and the steps every accountant and financial manager can and should take to protect assets and financial statements from fraud.

David L. Cotton, CPA, CFE, CGFM, is an accountant with Cotton, a Sikich Company, headquartered in Alexandria, Virginia. He has performed grant and contract, indirect cost rate, financial statement, financial related, and performance audits for more than two dozen Federal inspectors general as well as numerous other Federal and State agencies and programs.

Dave received a BS in mechanical engineering (1971) and an MBA in management science and labor relations (1972) from Lehigh University in Bethlehem, PA. He also pursued graduate studies in accounting and auditing at the University of Chicago Graduate School of Business (1977 to 1978).

Dave served on the Advisory Council on Government Auditing Standards (the Council advises the United States Comptroller General on promulgation of Government Auditing Standards—GAO’s yellow book) from 2006 to 2009. He served on the Institute of Internal Auditors (IIA) Anti-Fraud Programs and Controls Task Force and co-authored Managing the Business Risk of Fraud: A Practical Guide. He served on the American Institute of CPAs Anti-Fraud Task Force and co-authored Management Override: The Achilles Heel of Fraud Prevention.

Dave is the past-chair of the AICPA Federal Accounting and Auditing Subcommittee and has served on the AICPA Governmental Accounting and Auditing Committee and the Government Technical Standards Subcommittee of the AICPA Professional Ethics Executive Committee.

Dave chaired the Fraud Risk Management Task Force, sponsored by COSO and ACFE and is a principal author of the COSO-ACFE Fraud Risk Management Guide. Dave has testified as an expert in governmental accounting, auditing, and fraud issues before the United States Court of Federal Claims and other administrative and judicial bodies. He has been an instructor for the George Washington University masters of accountancy program (Fraud Examination and Forensic Accounting), and has instructed for the George Mason University Small Business Development Center (Fundamentals of Accounting for Government Contracts).

Dave was the recipient of the ACFE 2018 Certified Fraud Examiner of the Year Award (“presented to a CFE who has demonstrated outstanding achievement in the field of 2 fraud examination … based on their contributions to the ACFE, to the profession, and to the community”).

Alan M. Buie, JD, is an Assistant United States Attorney in the Western District of Texas, assigned to the Austin office. After graduating from law school in 1992, he clerked for a judge for two years and then spent six years in private practice in Washington, DC.

Alan entered government service in the Fort Worth office of the SEC in 2000 and served there as an enforcement attorney until 2005. In 2005, he became an Assistant United States Attorney for the Northern District of Texas, assigned to the Fort Worth Office, and served there until 2008. From 2008 to 2012, Alan served in the Dallas office as the corporate and securities fraud AUSA for the Northern District of Texas.

In 2012, Alan began serving in his current position, where he represents the government in criminal cases in federal district court, with a particular emphasis on investment fraud and other financial crimes.

Sandra Johnigan is a CPA, Certified in Financial Forensics, and a Certified Fraud Examiner. She currently serves as an Editorial Advisor to the Journal of Accountancy. She served a four-year term, completed in 2016, as a member of the Auditing Standards Board of the American Institute of CPAs (AICPA). She is also one of the principal authors of the Committee of Sponsoring Organizations of the Treadway Commission’s (COSO) Fraud Risk Management Guide. The Guide is intended to serve as best practices guidance for organizations when implementing the COSO fraud risk assessment principle.

Ms. Johnigan is engaged by public companies in civil litigation involving internal controls, disclosures, fraud and accounting issues in SEC filings. Engagements by accounting firms have included the application of auditing standards and accounting principles to a wide variety of issues, including internal controls, allowance for loan losses, financial instruments, revenue recognition and detection of fraud. She has also been engaged by the Department of Justice and the Securities and Exchange Commission.
